R.Tej Health Analytics Private Limited (“R.Tej” or “We” or “Our”) is a company registered under the Companies Act, 2013, having its registered office at A125 3rdFloor New Friends (Sant Nagar) Colony South Delhi 110065. R.Tej is the author, publisher and owner of U Be Fit mobile application with any subdomain thereof, mobile/tablet/console applications or other present or future electronic modes (“U Be Fit”). 

U Be Fit mobile app facilitates the provision of “Services” (described below and as updated from time to time) to Clients and HCPs (collectively, the “Users” or “You” or “Your”). This notice describes how information collected on Our App, such as Personal Information, EHR and BMR, may be used and disclosed (“Privacy Policy”). This Privacy Policy also lays out how you can get access to the collected information. Please review it carefully.

We understand that information about you and your health is very personal. We strive to protect the User’s privacy. We are required by law to maintain the privacy of our Client’s Content. We are also required to provide notice of our legal duties and privacy practices with respect to the Client Content and to abide by the terms of this Privacy Policy currently in effect. We reserve the right to change the terms of this Privacy Policy and to make a new Notice effective for all Personal Information we maintain. 

By using our services, you consent to R.Tej collecting, using, storing, and disclosing personal information as required under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011. This means we need your explicit agreement before handling your personal information.

By agreeing to our Privacy Policy and Terms of Use, you agree that any Personal Information you provide is subject to these terms. This policy also applies to our parent company, affiliates, subsidiaries, or joint venture websites.

II. CONSENT

We request You to carefully read this Privacy Policy and Terms of Use of the prior to sharing personal information with us. The Privacy Policy applies to current and former Users. By visiting and/or accessing U Be Fit, You explicitly consent and agree to the Privacy Policy laid out herein and by providing Us Your personal information yourself or by making use of the Services provided through U Be Fit or through HCPs (as defined under the Terms of Use), You hereby acknowledge for the collection, receipt, storage, use, processing, disclosure and transfer of Your personal information in accordance with the provisions of this Privacy Policy. 

We shall not be liable with respect to the accuracy/authenticity/ genuineness/ misrepresentation/ fraud/ negligence, etc. of the information disclosed and We are in no way be responsible to verify the information provided by the User.

Opt Out

In the event You do not wish to be bound by these terms, You may opt-out of U Be Fit and its Services by deleting Your account. 

III. COLLECTION OF PERSONAL INFORMATION

“Personal Information” includes ‘sensitive personal data or information’ (as defined under applicable law) and other information that You share with Us whether directly or in combination with other information or is received from HCP, that personally identifies You or could be used to personally identify You. Information collected by us while rendering the Services through U Be Fit may include:

· Basic information collected during registration such as Your name, address, email, phone number, 

· Medical information such as allergens, medical records and medical history, diagnosis, prescriptions 

· Financial information such as credit card information and other payment mechanisms.

“Non- Personal Information” collected by us may include type of internet browser and operating system used, domain name of the website, cookies, number of visits, average time spent on the site, tabs viewed etc.

We require permission for reading & writing files on external storage to allow Users to upload & save data on U Be Fit. Client’s retain the right and control to grant and revoke access to Client Content. U Be Fit further requires, phone camera (and audio) permissions in order to upload data to U Be Fit for comprehensive provision of services.

We don't scan any other files from your storage system other than the files you're explicitly uploading

We require permission to use images or capture image from camera for updating profile photo, uploading images as medical record or measuring heart rate using Camera.

IV. COOKIES 

Cookies are small pieces of data stored on your device that contain information about You, often used as a unique identifier. R.Tej and other third parties use these cookies to gather information about You. These cookies don't give us access to your device. We use them to improve our service. Some cookies may remember personal information you’ve provided. Most web browsers accept cookies by default, but You can choose to remove or reject them, though this might affect some features of the portal. Other websites may also use cookies and collect data or personal information, for which we’re not responsible. We suggest You read the privacy policies of all external sites.

If someone visits our Portal without reading the Privacy Policy and Terms of Use first, and they disagree with how we gather, store, or use information, simply closing the browser should remove any temporary cookies installed by R.Tej. We suggest all visitors use their browser's “clear cookies” feature to ensure this removal, as we can't control how all visitors' equipment behaves.

V. USE OF PERSONAL INFORMATION

You agree and acknowledge that information provided by Client or by HCP on behalf of Client, may be used by R. Tej for the following purposes:

· to comply with central, state or local laws that require disclosure;

· to respond to law enforcement officials or to judicial orders, subpoenas or other process;

· to avert a serious threat to health or safety;

· to enable the provision of Services opted by You including collating all User medical records, reports and other data; 

· to enable the viewing of content in Your interest;

· to copy, reproduce, store, distribute, publish, export, adapt, edit and translate Personal Information to the extent reasonably required for the provision of Services by R.Tej;

· to provide better products and Services and to programmatically use Your data to give You contextual Services.

· to fulfil Your requests for certain Services;

· to contact You about Our Services;

· to respond to Your feedback and queries to provide better customer service;

· to track User activity on U Be Fit to personalize and improve User experience;

· to use Your information to operate, improve and maintain our site, to prevent fraud and abuse;

· to fulfil any other purpose for which You provide Us Personal Information; and

· for any other purpose for which You give Us authorization.

Uses of Information that do not require an authorization:

We may retain Non-Personal Information and will continue to use Non-Personal Information as permitted under this Privacy Policy and applicable law. 

R.Tej may additionally use Your basic information or contact information if required for the purposes of: (i) processing User registration to use our Services on U Be Fit; (ii) dealing with any complaint, queries or problems reported by User regarding the Services; and (iii) notifying You of changes in the Services and help improve the Services Company provide to you.

VI. DISCLOSURE OF PERSONAL INFORMATION

We may disclose Personal Information that We collect from You or that You provide:

· to deal with requests, enquiries, complaints or disputes and other customer care related activities including those arising out of the Users’ request of the Services and all other general administrative and business purposes;

· to contractors, service providers and other third parties for analytics and communications and who are bound by contractual obligations to keep Personal Information confidential;

· as required by law, which can include providing information as required by a court order;

· when we believe in good faith that disclosure is necessary to protect Your safety or the safety of others, to protect Our rights, to investigate fraud, or to respond to a government request;

· to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all company’s assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which Personal Information maintained by U Be Fit is among the assets transferred; 

· for any other purpose disclosed by Us when You provide the Personal Information;

· to government institutions/ authorities to the extent required (i) under the laws, rules, and regulations and/ or under orders of any relevant judicial or quasi-judicial authority; (ii) to protect and defend the rights or property of R. Tej; (iii) to fight fraud and credit risk; (iv) to enforce R.Tej Terms; or (v) when R.Tej, in its sole discretion, deems it necessary in order to protect its rights or the rights of others; and

· if otherwise required by an order under any law for the time being in force including in response to enquiries by Government agencies for the purpose of verification of identity, or for prevention, detection, investigation including cyber incidents, prosecution, and punishment of offences.

VII. SECURITY 

Your security matters to Us. R. Tej implements reasonable security measures, including technical, operational, managerial, and physical controls, to safeguard all user information, including Personal Information, from loss, misuse, and unauthorized access, disclosure, alteration, and destruction.

All user information is encrypted during transmission and stored encrypted at rest. We take reasonable steps to protect your Personal Information to prevent loss, misuse, unauthorized access, disclosure, alteration, and destruction.

We are not liable for the disclosure of your Personal Information due to transmission errors, unauthorized third-party access, or other causes beyond our control. While we've taken reasonable measures to protect your privacy rights on U Be Fit and Services, we're not responsible for unauthorized disclosures made by third parties not under our control.

DO NOT SHARE YOUR ONE TIME PASSWORD ("OTP") WITH ANYONE.

VIII. CONFIDENTIALITY 

You understand that U be Fit may have confidential information, and You agree not to share that information without our written permission. Your information is considered confidential and won’t be shared with third parties unless legally required, or as outlined in this Privacy Policy or Terms of Use. We won’t sell your personal information to third parties or send unsolicited emails. Any emails we send will be related to the services you've agreed to, and you can choose to stop receiving them at any time.

IX. USER’S RIGHTS

All the information provided to R.Tej by a User, including Personal Information, is voluntary. User has the right to withdraw consent at any time, in accordance with the Terms.

X. COMMUNICATION

Users can access, modify, correct and delete the Personal Information. However, We may retain a copy of information originally provided in Our archives. In case the User seeks to update or correct, his/ her/ its Personal Information, the User may exercise these rights by emailing R.Tej at info@souldigify.com  and communicate the change(s) for updating Our records.

XI. DISCONTINUATION OF SERVICES

In case User does not provide its information or consent for usage of Personal Information or subsequently withdraws consent for usage of the Personal Information so collected, R.Tej reserves the right to discontinue Services for which the said information was sought.

XII. GRIEVANCE REDRESSAL
